Woohoo Websites — Terms of Service

Please read these Terms carefully. They describe the terms under which Woohoo Websites provides its services.

1. Agreement to These Terms

These Terms of Service (“Terms”) govern the website design, hosting, maintenance, lead-generation, and related services provided by Woohoo Websites (“Woohoo,” “we,” “us,” or “our”). By purchasing a package, submitting project information, approving a website, or continuing to use our recurring services, you agree to these Terms.

2. Packages and Included Services

Woohoo One — $199 setup + $49/month. Includes one professionally built scrolling website, a contact or estimate-request form, mobile-friendly design, click-to-call functionality where appropriate, basic SEO setup, Google Business Profile and Maps setup where applicable, custom-domain connection, managed hosting, SSL, backups, maintenance, and reasonable basic text and photo updates to existing content.

Woohoo Five — $499 setup + $49/month. Includes the Woohoo One features plus up to five professionally built website pages, basic SEO setup on included pages, and additional room for services, galleries, reviews, service areas, company information, and similar business content.

Woohoo Lead Machine — $799 setup + $99/month. Includes up to five professionally built website pages plus one custom lead magnet (such as a guide, checklist, or downloadable resource), one dedicated lead-capture landing page, one opt-in form, one thank-you page, one automated lead-magnet delivery email setup, one simple CRM setup for capturing and organizing leads, and one online-booking setup.

Lead Machine does not include unlimited funnels, unlimited lead magnets, ongoing email-campaign creation, advertising management, sales services, unlimited CRM administration, unlimited booking administration, or unlimited marketing work unless separately agreed in writing.

3. Setup Fees, Recurring Billing, and Automatic Renewal

The applicable setup fee and first recurring monthly charge are due at checkout. Recurring service begins on the purchase date and automatically renews monthly using the payment method provided at checkout until canceled.

Woohoo One and Woohoo Five renew at $49 per month. Woohoo Lead Machine renews at $99 per month. There is no free trial unless Woohoo expressly offers one in writing for a specific promotion.

You authorize Woohoo and its payment processor to charge the recurring amount and any separately approved charges to the payment method on file. Applicable taxes, if any, may be added as required by law.

4. No Long-Term Contract; Cancellation

Woohoo services are month-to-month unless otherwise agreed in writing. You may cancel at any time by contacting us at hello@woohoowebsites.com or through any cancellation method we make available.

Cancellation prevents future renewals after the current paid billing period. Cancellation does not automatically refund setup fees, completed work, prior subscription charges, or the current paid billing period.

At the end of the paid service period, Woohoo may discontinue hosting, forms, CRM connections, booking tools, email automations, maintenance, and other managed services associated with the canceled package.

5. Setup-Fee Refund Policy

A setup fee may be refundable if you cancel before Woohoo begins project work. Once Woohoo has received sufficient project information and has begun generation, design, writing, configuration, setup, or other production work, the setup fee is non-refundable.

If Woohoo is unable or unwilling to complete a purchased project for reasons unrelated to the customer, Woohoo may provide an appropriate refund or other remedy at its discretion, subject to applicable law.

6. Customer Information and Materials

You are responsible for providing accurate and lawful information needed to complete the project, which may include your business name, contact information, services, service areas, hours, domain information, logo, photos, reviews, claims, licenses, insurance information, social links, offers, and other requested materials.

Woohoo may rely on the information you provide. We are not responsible for errors, legal claims, delays, or lost opportunities caused by inaccurate, incomplete, outdated, misleading, or unauthorized customer-provided information or materials.

7. Production Timeline and Customer Delays

Woohoo generally aims to provide a first draft within one business day after receiving the completed information reasonably required to begin. This is a target rather than a guaranteed deadline.

Complex projects, missing information, customer delays, domain or DNS issues, weekends, holidays, third-party outages, unusually high order volume, or other circumstances may extend production or launch time.

8. Initial Revisions and Scope Changes

Unless a written offer states otherwise, each website package includes one reasonable revision round before launch. A revision round is intended for corrections and reasonable adjustments to the agreed website and supplied information.

Major redesigns, repeated changes in direction, additional pages, new funnels, substantial new copy, custom programming, new integrations, or work outside the purchased package may require an additional fee. Woohoo will disclose additional charges before performing separately billable work.

9. Included Basic Text and Photo Updates

Active recurring website-management service includes reasonable minor changes to existing site content, such as updating contact information, business hours, existing service descriptions, existing photos, or similar small edits.

Included updates do not cover complete redesigns, new websites, new pages beyond the purchased scope, new funnels, new lead magnets, large copywriting projects, custom functionality, ongoing SEO campaigns, advertising, repeated design changes, or other substantial work. Woohoo determines in good faith whether a requested change falls within included maintenance and will quote additional work when necessary.

10. Customer Review and Approval

You are responsible for reviewing your website before launch, including names, phone numbers, addresses, prices, offers, service descriptions, legal claims, reviews, licenses, and other business information. Your approval authorizes Woohoo to publish the site using the approved information.

Woohoo may correct obvious formatting or technical issues after launch, but customer approval does not make Woohoo responsible for factual or legal inaccuracies supplied or approved by the customer.

11. Hosting, Security, Backups, and Availability

Woohoo uses third-party hosting, software, plugins, APIs, domain services, security tools, and other technology to provide its services. Active recurring service includes managed hosting, SSL, backups, and routine technical maintenance as described in the purchased package.

We take reasonable steps to maintain availability and security, but no website, server, software, internet connection, or third-party service can be guaranteed to operate without interruption, error, data loss, or security incident. Temporary downtime may occur for maintenance, updates, outages, DNS issues, security events, or circumstances outside Woohoo’s reasonable control.

12. Domains

Whenever practical, customers should own and maintain registration of their own domain name. Woohoo may assist with purchasing, connecting, configuring, or managing a domain.

Unless expressly included in a written offer, domain-registration and renewal fees are the customer’s responsibility. Woohoo is not responsible for loss or interruption caused by expired registration, inaccurate account information, registrar action, customer action, or other circumstances outside our control.

13. Website Ownership, Customer Content, and Reusable Woohoo Materials

You retain ownership of logos, photographs, trademarks, written materials, and other original content you provide. After all applicable setup fees are paid, you also own the custom business copy and customer-specific creative content Woohoo creates specifically for your project, subject to any third-party licenses.

Woohoo retains ownership of its reusable templates, systems, processes, workflows, prompts, design methods, code libraries, reusable components, internal tools, and know-how. Third-party software, plugins, fonts, stock assets, and platform components remain subject to their own licenses.

Your monthly subscription covers Woohoo’s managed hosting and ongoing service. If you cancel and want the website moved elsewhere, Woohoo may provide an export or reasonable transfer assistance where technically feasible. Migration or transfer work is not included in the standard monthly subscription and may require an additional fee disclosed before work begins.

14. Portfolio and Marketing Use

Unless you ask us in writing not to do so, Woohoo may display screenshots, links, or non-confidential portions of completed work in our portfolio, social media, advertising, demonstrations, or other marketing materials. We will not knowingly disclose confidential customer information through portfolio use.

15. Third-Party Services and Fees

Woohoo may use third-party providers for website hosting, WordPress services, payment processing, forms, file uploads, email, CRM, booking, analytics, domains, maps, artificial-intelligence-assisted production tools, and related functionality.

Third-party services are governed by their own terms, policies, limits, availability, and pricing. Woohoo is not responsible for third-party outages, policy changes, discontinued features, account suspensions, or pricing changes outside our control. Third-party subscription or usage fees are not included unless the applicable Woohoo package or written proposal expressly says they are.

16. Lead Generation, SEO, Google, and Business Results

Woohoo builds websites and systems intended to help businesses present themselves professionally and make it easier for visitors to call, contact, request information, book, or otherwise take action.

Woohoo does not guarantee any number of leads, phone calls, customers, appointments, sales, revenue, traffic, conversion rate, Google ranking, Google Maps ranking, search-engine placement, or return on investment. “Let’s Make the Phone Ring” is a marketing slogan and not a promise of a specific result.

Google Business Profile and Maps setup may include connecting website information, links, maps, service-area information, or booking links. Woohoo cannot guarantee Google verification, approval, ranking, placement, or visibility.

17. Lead Machine, Email, CRM, Booking, and Marketing Compliance

Lead Machine features are setup and operational tools, not an ongoing marketing-agency retainer unless separately purchased. Customers are responsible for the lawful use of leads, email, CRM, booking, and marketing features.

Customers must obtain any consent required by law before sending marketing email, text messages, or other communications. Customers may not use Woohoo-provided systems for spam, deceptive marketing, unlawful messaging, purchased or improperly obtained contact lists, or other illegal activity.

18. Payments, Failed Charges, and Suspension

If a recurring payment fails, Woohoo or its payment processor may retry the charge and contact you regarding payment. Woohoo may suspend maintenance, forms, CRM/booking functionality, hosting, or other services for continued nonpayment after reasonable notice.

You remain responsible for valid charges incurred before cancellation or termination. If you believe a charge is incorrect, contact Woohoo promptly so we can review it.

19. Prohibited Uses and Right to Refuse Service

Woohoo may refuse, suspend, or terminate service for unlawful activity, fraud, intellectual-property infringement, malware, deceptive practices, harassment, hate or extremist activity, prohibited goods or services, or other content or conduct that we reasonably believe creates legal, technical, payment-processing, security, or reputational risk.

20. Disclaimer of Warranties

Except for any express written commitments in these Terms or a written proposal, services are provided on an “as is” and “as available” basis to the maximum extent permitted by law. Woohoo disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability to the extent permitted by applicable law.

21. Limitation of Liability

To the maximum extent permitted by applicable law, Woohoo will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages arising from the services, website downtime, third-party services, loss of leads, lost business, or inability to use a website.

To the maximum extent permitted by law, Woohoo’s aggregate liability arising from a claim will not exceed the amount you paid Woohoo during the three months immediately preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot legally be limited.

22. Indemnification

You agree to defend, indemnify, and hold Woohoo harmless from third-party claims, damages, liabilities, and reasonable costs arising from customer-provided content, false or misleading business information, intellectual-property violations involving supplied materials, unlawful marketing communications, products or services you sell, illegal use of your website, or your violation of these Terms or applicable law.

23. Changes to Services or Terms

Woohoo may improve, modify, replace, or discontinue features as technology and third-party platforms change. We may update these Terms from time to time. The current version will be posted on woohoowebsites.com with a revised effective date. Material changes affecting an active recurring service will be communicated when reasonably required by law.

24. Governing Law

These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law rules, except where federal law or other applicable law controls.
